SO 2017-26
Parliamentary Motions Act

WHEREAS the Parliament should have the opportunity to make use of motions;
NOTING that Parliament has at current no such opportunities;
BE IT ENACTED by the President of the Union, by and with the advice and consent of the Senators of the Union, in this present Parliament assembled, and by the authority of the same, as follows:-

Part I: Definitions
Article 1
A Parliamentary motion (hereafter ‘motion’) shall be defined as follows: “a formal proposal by a Member of Parliament that requests another body of governance to take a certain action or requests that a certain action will not be taken, or requests that the authority expresses an opinion”.

Article 2
A “Motion to Pass to a Vote” made during the debate of a bill or motion in Parliament does not fall under the provisions of this Act, but under those of SO 2016-03 (“Parliamentary Procedure Orders Act”).

Part II: General Provisions
Article 3
A motion must be written by a Member of Parliament. If in between the voting on the motion and the proposal of the motion the Member will lose his Seat in Parliament, the motion shall not be considered to be nulled and void. In such case the proposer may defend his motion until a vote has been taken.

Article 4
A motion may not be identical to another motion that has been introduced or that has been voted upon three weeks before its introduction. If it be so the Speaker of Parliament shall declare the motion nulled and void.

Article 5
Motions shall follow the procedure defined in SO 2017-03 (“Parliamentary Procedure Orders Act”) pertaining to ordinary bills of parliament, but shall not be forwarded to the President upon passage.

Article 6
If any Member of Parliament is or represents also the body that the motion is taken on or to, he may not take part in the vote. The Speaker shall declare his vote nulled and void if he does vote nonetheless.

Article 7
A motion shall pass the vote when it receives a simple majority (50% +1) among the Members of Parliament that took part in the voting legitimately.

Article 8
When a motion passes the vote, the Speaker of Parliament must notify the body/bodies of governance invoked by the motion of its passage, and request that they carry out its provisions.

Article 9
Motions are only binding if passed unanimously amongst those Members of Parliament voting.

Article 10
Motions may not involve matters:
a. That are already being debated upon or voted on because of a Bill;
b. That would violate the law upon the moment that the motion is introduced;
c. That requests an organ or position holder to come forward with a Constitutional Amendment.

Part III: Exceptional Provisions
Article 11
Motions of No Confidence request the resignation of one member of the Executive, and may be brought against the President, Prime Minister, Minister, or holder of any other executive position created by Parliament, but may not be brought against the Founder.

Article 12
Article 9 of this Act is excepted in the case of Motions of No Confidence.

Article 13
Motions of No Confidence are only binding only when passed against the Prime Minister or the Speaker pro tempore of Parliament.

Article 14
Motions of Confidence express support for a member or members of the Executive, and may be brought for the President, Prime Minister, Minister, or holder of any other executive position created by Parliament, but may not be brought for the Founder.

Article 15
Article 9 of this Act is excepted in the case of Motions of Confidence, which are never binding.

Part IV: Citation
Article 16
This Act may be cited as “[The] Parliamentary Motions Act 2017”.
