This bill has been sitting in my Google Drive for a few months now because I haven't known how exactly I'd handle a personal situation, however I now have decided that the best course of action would be to submit this before the term ends.  Please note that I am the sole author of this document and no other Members have contributed to its initial drafting.

Re: SO 2017-41 Regional Sport Act

I think the proposal of my Rt. Hon. friend [Libertarian Democracy] is very interesting. Though I would like to ask him if he will inform me about the relation between the Ministry and the Department. With regards to that I have two questions:

1) Does the text of Article 2.A.2) mean that it would be possible for the Minister to appoint himself as Commissioner? And if so, would my Rt. Hon. friend the Author consider to change this if it be the case. I would like to ask for an explanation if he is not willing to consider such a change if the Minister can appoint himself.

2) What is the hierarchical relation among the Minister, the Commissioner, and the Department as a whole? Is it to be understood that the Ministry may issue orders that the Department will have to follow, or is the Department entirely free to make their own policies? What will be the role of the Commissioner during their respective proceedings? Will he act more like an independent speaker, or will he stand somehow above the other Members? And how is this all reflected by the appointment of the Members?

1) While I believe there may be an argument for the MoD appointing himself in a time of inactivity, it is of my opinion that said argument is strong enough to outweigh the benefits of a diverse Executive Branch.  Therefore, I have updated Article II, Section A to address your concern.

2) As per Article II, Section A, Clause 2, the Department is a branch of the Ministry of Development.  However, this proposal would grant the Department certain privileges that are not granted to the Ministry in its entirety.  The only Ministry influence permitted by this proposal is the appointment of the members of the UCS.

The Department of Sport is led by the UCS.  These were made as separate entities to allow for expansion.  For example, if the UCS voted to create the position of, say, Olympic Referee, they could legally do so by establishing it as a position within the Department, but not on the governing council (The UCS).

I did not want to specifically regulate the proceedings of the UCS, as that would restrict their independence and operation.  To apply the rationale to this Legislature, it was the Parliament who established the Parliamentary Procedure Orders, and not the Constitution.  With the same logic, I think the members of the UCS would be capable of defining their own procedure.

The Commissioner is intended to be the symbolic figurehead of the Department of Sport.  I tried to express this intention through the name of the position and in Article IV, Section B, Section 2, but I will update the proposal to explicitly command this through a provision in Article II.

EDIT: Added Article II, Section C.
