SO 2017-52

SO#2017-52 Amendments to SO#2016-18

Noting that the current election system can independents without a seat despite receiving as many votes as the candidates with a seat, and we believe that a more democratic system can be implemented;
Be it enacted with the consent of Parliament as follows:-

Article I
Guidelines 7 and 8 of SO#2016-18 shall have their numbers changed to 8 and 9 respectively.

Article II
The following text shall be added to SO#2016-18 as Article III, Guideline 7, Point A:
Whenever a number of independents have equal votes, and are competing for a smaller number of seats than the number of candidates concerned, a runoff election will be called between the drawn
candidates.

The following text shall be added to SO#2016-18 as Article III, Guideline 7, Point B:
When such an election is called, the founder will announce on the regional message board that the election will occur in a day and that should anyone wish to withdraw they must send the founder a
telegram. Once a day has passed since the announcement the founder will create a poll for the runoff election with a time of two days. If the election finishes in a draw between one of more
candidates, then the seats are awarded to the nation with longest permanent residency. Once the election has finished the founder will announce the results on the regional message board.

First, a small grammar/syntax error.  The first line doesn't really make sense.

I completely support this proposal's premise.  I like the idea of a runoff election in the event of a tie, and I especially like how Article II is worded.

However, there is one small legal issue with this proposal.  This bill would directly conflict with SO#2016-18 ("Parliamentary Elections Act") Article III, Guideline 5:
The Founder will then ascertain, from the Seats per party according to Sainte-Lague method line in the Resulting table, the number of seats to award to each electoral list.
So basically this proposal needs to be reformatted as an amendment to SO#2016-18.  I suggest the following:

SO#2017-52 Amendments to SO#2016-18

Article I: Preface
We, the Parliament of the Union, in order to ensure fairness in the electoral process of this very legislative body, do hereby amend SO#2016-18 to allow for runoff elections in the event of a tie between multiple candidates for the same seat."

Article II: Amendments
Section A:
Article III, Guidelines 7 and 8 of SO#2016-18 shall have their numbering incremented by one.
Section B:
The following text shall be added to SO#2016-18 as Article III, Guideline 7, Point A:
"Whenever a number of independents have equal votes, and are competing for a smaller number than the number of candidates a runoff election will be called between the drawn candidates."
Section C:
The following text shall be added to SO#2016-18 as Article III, Guideline 7, Point B:
"When such an election is called, the founder will announce on the regional message board that the election will occur in a day and that should anyone wish to withdraw they must send the founder a telegram. Once a day has passed since the announcement the founder will create a poll for the runoff election with a time of two days, once the election has finished the founder will announce the results on the regional message board. "

Article III: Conclusion
We, the Parliament of the Union, hereby amend SO#2016-18 pursuant to the above provisions.

I agree with Libertarian Democracy (was just about to propose exactly the same thing), but one other thing: I think that we should specify that if the runoff election results in another tie, the result is decided in favor of the nation with the longest permanent residency (just as in other elections), so that we don't end up running elections over and over again through half the parliamentary term.

Also, I think you mean: Whenever a number of independents have equal votes, and are competing for a smaller number of seats than the number of candidates concerned.
