Refound Day Commemoration Act
-by the President of the Union, by and with the advice and consent of the Senators of the Union, in this present Parliament assembled, and by the authority of the same;
WHEREAS the moving of the Union’s region on June 4, 2016, was an action which ensured the survival of the Union and its integrity, and
WHEREAS that “refound” should be commemorated and celebrated by the Union for all its existence, be it therefore
ORDERED that June 4 shall be a Regional Holiday as defined by SO#2016-04 (“Regional Holidays Act 2016”), to be named “Refound Day”, and to be celebrated as such by the Union.

Would the Chair advise me whether or not I could introduce such a holiday by Executive Degree in the future, rather than through a Bill of Parliament?

I thank the honorable member for his question. I rule that as the original Regional Holidays Act was passed through parliament, there is sufficient precedent to reserve the powers of creating repeating holidays to the Parliament through Act. In addition, the President's duties as described in the Constitution indicate that the President has supreme authority over external affairs (embassies, war), not domestic ones. Therefore, should any non-repeating holidays be decreed, they should come from the Ministry of Development or the Minister without portfolio's office.

While precedent is great when requiring advice how to act, it is not legally binding. Parliament should legislate.

What I mean is that the wording of the Act implies that establishing this kind of holiday should be done through Act.
Nevertheless, I would totally support/write an act reserving certain areas of governance to the various branches.
